This is the listing of offers for power
sales of one month or more that must be consumed in Washington , Oregon
, Idaho or the area of Montana west of the Continental Divide. Delivery
of power shall be at Mid-Columbia unless otherwise agreed. Offers may
be cancelled without notice. Credit restrictions and other requisite
terms shall apply. |

NOTICE OF POTENTIAL SURPLUS ELECTRIC
ENERGY FOR SALE
PUD No. 2 of Grant County ("GCPUD") may, from time to
time, have surplus electric energy to sell. Available quantities and prices
of surplus energy will vary. GCPUD will make such surplus electric energy
sales under terms consistent with Bonneville Power Administration's Policy
on Determining Net Requirements of Pacific Northwest Utility Customers under
Sections 5(b)(1) and 9(c) of the Northwest Power Act.
Information regarding GCPUD'S available surplus electric energy will be made
available from time to time on this web page, and will specify quantity, price
and other relevant terms and conditions for each offer at the time that such
offer is made. In addition, qualified regional buyers that provide an appropriate
contact name, email address, and phone number may also receive direct emails
regarding such offers. If anyone in your company is interested in receiving such
notifications by email, please have that person or persons send an email request

Bids in response to a specific offer will be subject to GCPUD's credit policy
and ADDITIONAL REQUISITE TERMS outlined below. To demonstrate interest, parties
must call one of the contact person(s) specified in the offer. If no qualified
regional entity accepts an offer made in this manner, as provided in the policy,
the surplus electric energy may then be made available for sale to out-of-region
entities.
ADDITIONAL REQUISITE TERMS
"[Purchaser] acknowledges and agrees that Public Utility District No.
2 of Grant County, Washington ("Grant") is a municipal utility that
is generally exempt from the jurisdiction of the Federal Energy Regulatory
Commission ("FERC") pursuant to §201(f) of the Federal Power
Act and, therefore, that the terms of this [Power Sale] Agreement, including
the price or prices established herein, are not subject to review, approval,
or modification by any state or federal regulatory authority. If, however,
any court of competent jurisdiction should determine that this [Power Sale]
Agreement is subject to any regulatory authority, it is the Parties' intention
that, except as otherwise expressly provided, this [Power Sale] Agreement is
a fixed rate contract and may be changed only in accordance with the standards
established by and under the decisions of the United States Supreme Court in
FPC v. Sierra Pacific Power Co., 350 U.S. 348 (1956), and United Gas Pipe Line
Co. v. Mobile Gas Service Corp., 350 U.S. 332 (1956).
[Purchaser] further covenants and agrees that any electrical power purchased
from Grant pursuant to this agreement shall be used exclusively to serve retail
load within the Pacific Northwest Region as defined by the Northwest Electric
Power and Conservation Act, P. L. 96-501. Should Purchaser fail to do so, it
shall indemnify Grant from and against any costs, expenses, or adverse financial
consequences of any type incurred by Grant arising from or related to Purchaser's
violation of this covenant."
